Case Against Henderson Man Who Claimed Self-Defense Dropped

Review-Journal
Short version; idiots pop off rounds behind a car wash that butts up against homes. A man who was awake at the late hour sees the idiots out there shooting in random directions and thinks it's his son's drug dealers. Man shoots one of the idiots dead. The man had the charges dismissed because the DA couldn't make the charges stick at trial.

I would recommend not firing until you have no other choice to avoid situations like this. Also don't ever talk to the police without an attorney. Consider signing up for a USCCA membership so you're not stuck with a public defender at 3 AM.

Election 2020: In Case We Go Dark

​Tuesday, November 3rd, 2020, Election Day, will be the most pivotal day in American history since 1861. It may very well mark the beginning of the end of our republic. Whatever the outcome of this election is, it promises chaos. This message is going to be a heavy one.
 
I’m writing for several reasons. The first is to assure any leftist blog monitors or government agencies that I’m not some sort of guerrilla leader or planning any violence. Nor do I know of any.  
 
I’m not suicidal, I have no plans or intentions on hurting anyone, and I don’t have evidence that incriminates Hillary Clinton Hunter and Joe Biden. Yours truly isn’t going to “boogaloo” or anything like that. If this were 1776, maybe, but it isn’t such a moment in my worldview. I believe Jesus is coming back soon and the mess the world has found itself in this year is the major prelude to that. My goal is to get my family through the dark times until the Lord’s return and not wage a guerilla war trying to prop up a failing system.
 
Now I don’t mean to disparage anyone who feels they need to do their patriotic duty. If I believed differently or felt the End Times weren’t nigh, I’d be right there with you. But again, this isn’t my fight. Should we find ourselves in a hot civil war, I wish you godspeed. My heart is with you. I just can’t justify direct action except in immediately self-defense. Whatever my part is in saving souls, that is my primary objective.
 
There may soon come a time when any one of us could be rounded up for the proverbial boxcar, be it for our religious or political views. It doesn’t have to be because of yellow star, a cross, or if we voted for Trump. We must fight becoming captives. All of us know what happened to the Jews who meekly got on the trains and ended up in camps. Communism kills and it will kill you for opposing it.
 
Each person must make a decision on where they stand and where they draw the line in the sand. I’ve got mine and you must make yours. Resist gun confiscation. How you do that (boating accident) or “Guns of Brixton” style is your choice. It is not something to decide lightly because the consequences either way can be enormous. But whatever the case, gun registration leads to confiscation and confiscation will lead to tyranny and mass murder.
 
Assuming the Nevada legislature stays in the Democratic stranglehold, COVID-19 will be probably used as an excuse to keep the public out of the statehouse. Dissent will be crushed in favor of Zoom meetings that the legislators can ignore. They’ll do what they feel they can get away with. So if you haven’t voted yet, vote Republican in any state race.
 
The blog may go suddenly dark. I don’t know what exactly the future holds but Nevada Carry, as small as we might be, is a tall nail. Not that I’m a coward by any means, but one must pick his battles. I really don’t want to get disappeared. Facebook will probably zap all right-leaning groups and pages and my webhost might do the same. And if Google kills the ad revenue stream, well see you later.
 
As long as we can, even if Democrats win, we will try and keep people informed of what’s going on and what’s legal or not. First and foremost, we’re about educating people about the gun laws to keep them armed instead of ill-informed, afraid, and disarmed. Best case scenario if the worst happens, the website will be updated with local gun laws and info to keep you armed in the safest and most legal way possible. We will try and keep it up until the subscriptions expire, but active maintenance might not occur.
 
Nevertheless, the hour for which the Second Amendment was created approaches. Each man to his own, as the saying goes. Remember, the Declaration of Independence sets forth the criteria for armed overthrow of the government. The price for failure is treason. Make your dispositions accordingly.
 
With any lucky, the days after next Tuesday will be exciting, but not the end of the world, and we’ll still be here fighting the good fight. Worst case, we might just disappear into the Internet ether without warming.

Strip Violence Mostly California's Fault

We know that COVID-19 and low rates have brought a lot of low-class trash into Las Vegas, and a lot of it is from California. Maybe blaming it all on our western neighbor is a little hyperbolic, but it's probably true and these two articles from the Review-Journal don't help.

The first article's title says it all: "Police: Gunman in Strip shooting just released from prison." "A south-central Los Angeles man" two-months out of prison for gun crimes was arrested for a shooting  on the Strip. We have a felon, carrying a firearm, with a past history of breaking gun control laws. Hmm, seems like gun control laws don't work? 

Some other dudes, part of a large group on a party bus that was here from California for someone's birthday, got involved in two shootings. Disturbingly, from the second incident the suspects followed victims on foot and in vehicles for 15 minutes, some of them even taking up "overwatch" positions in a parking garage.

This problem exists because low hotel rates have drawn scumbags from California like rats flocking to a new trash pile. This isn't Las Vegas' doing; it's the product of totally wrong COVID-19 shutdowns devastating our economy so much that casinos have to drop rates to get people to visit. Unfortunately, that brings in the poor, low quality humans that couldn't afford this place normally (not that they really can now). 

But of course, guns will be blamed. If it wasn't for that evil ghost gun, the guy from Story #1 wouldn't have been able to get a gun! Ha! And of course the solution will be to disarm people on the Strip because government regulations only come in one-size-fits-all.

If they want to ban guns on the Strip, they need to exempt those with carry permits. Not because I support that kind of thing, but at least the government would be admitting we aren't the problem and that good people do have the right to protect themselves. Plus it wouldn't be a bad, blanket solution that penalizes everyone for something that isn't our fault. 

Want to fix this problem? Stop letting criminals out of jail early and give them the sentences that are on the books; no early time, no light sentences. Stop killing the economy and making people desperate and crazy. Normalize the economy and the tourists come back. Rates go up and the rats will go back to California. While you're sending the California criminals back, take a certain carpetbagging legislator who loves gun control with you.

The LA Times did an article on open carry at polling places. ​Nevada's attorney general, Aaron Ford, actually said that open carry wasn't illegal at a polling place. 
The right to carry firearms and the right to vote without fear of intimidation “are concurrent rights that can operate simultaneously and in fact, do operate simultaneously here in our state,” Nevada Atty. Gen. Aaron Ford, a Democrat, said on a press call this month.
“The line that will be crossed is a line of intimidation. To the extent you violate the law relative to using your firearm to intimidate or coerce, or to unduly influence someone, that’s going to be considered voter intimidation,” Ford said. “The mere presence of a firearm at a public polling location, in and of itself, won’t rise to that level.”
I'm actually surprised at how even-handed he is. There's a lot that could be said by my personal theory is this: Democrats know Nevada is still purple and are trying their best to appear level-headed and not go full retard. If they go full retard, they will get stung with the backlash. 

Until Nevada is solidly blue and the demographics have changed enough (with other parts of the political landscape) they can't simply do what they want. All of that depends on elections. Eventually, immigration and migration from California will turn Nevada blue and most other red states purple.

So while the tide has turned against us, at least Nevada's top cop is telling the truth and isn't calling for a ban. The attempt to repeal preemption in 2020 will be another story.

Know Your Self-Defense Laws: Clerk Facing 20 Years for Shooting Beer Thief

In this morning's Review-Journal, a Las Vegas convenience store clerk plead guilty to voluntary manslaughter for shooting and killing a beer thief who was getting away. 

You cannot shoot someone to recover or protect property; you may only use deadly force to protect yourself or someone else from great bodily harm or death. It's a little more nuanced than that, so read the laws on self-defense and justifiable homicide, take a CCW course, and if you ever get into a defensive gun use, get an attorney before you talk to the police.

This is not the first time this has happened. From the article:
In 2015, a former 7-Eleven clerk was sentenced to four to 12 years in prison for shooting a would-be beer thief as he ran from the store.

In February 2018, a Las Vegas smoke shop clerk was sentenced to probation for shooting and killing a 13-year-old boy who had rushed into the store wearing a mask and hoodie.
Hopefully, you will not be so stupid as those above. However, you may well find yourself in a situation where you righteously defend yourself yet and still are in legal peril.

Green Valley Ranch Sued for Security's 2019 Shooting of Man

We reported this back in 2019 where it appeared then the deceased had a gun in his hand and had a suicide note. The details being claimed in the Review-Journal are interesting. As no one was criminally charged, the furtive movement claim for self-defense was enough for it to be justifiable homicide. The story the attorney paints is bad, but it's his job to make it look ugly. 

It sure would be nice to read the police report and see the video first hand, but we here don't have the time or the money for the public record requests.

Note that there is no legal protection for self-defense shootings outside your home or vehicle.

Can You Be Sued if You Shoot Someone in Self-Defense (in Nevada)?

Yes, you can be sued if you shoot someone in self-defense. Anyone can file a lawsuit for anything. This is Nevada; the personal injury attorneys here will take anything they can get. The questions is, under what circumstances will that suit be dismissed? 
NRS 41.095  Presumption that person using deadly force against intruder in person’s residence, transient lodging or motor vehicle has reasonable fear of death or bodily injury; person who uses deadly force is immune from civil liability under certain circumstances; definitions.
      1.  For the purposes of NRS 41.085 and 41.130, any person who uses:
      (a) While lawfully in his or her residence, in transient lodging or in a motor vehicle that is not his or her residence, force which is intended or likely to cause death or bodily injury is presumed to have had a reasonable fear of imminent death or bodily injury to himself or herself or another person lawfully in the residence, transient lodging or motor vehicle if the force is used against a person who is committing burglary, invasion of the home or grand larceny of the motor vehicle with the use or threatened use of a deadly weapon and the person using the force knew or had reason to believe that burglary, invasion of the home or grand larceny of the motor vehicle with the use or threatened use of a deadly weapon was being committed. An action to recover damages for personal injuries to or the wrongful death of the person who committed burglary, invasion of the home or grand larceny of the motor vehicle with the use or threatened use of a deadly weapon may not be maintained against the person who used such force unless the presumption is overcome by clear and convincing evidence to the contrary.
      (b) Force which is intended or likely to cause death or bodily injury is immune from civil liability in an action to recover damages for personal injuries to or the wrongful death of a person against whom such force was used if the use of such force was justified under the applicable provisions of chapter 200 of NRS relating to the use of such force.
      2.  As used in this section:
      (a) “Deadly weapon” has the meaning ascribed to it in NRS 193.165.
      (b) “Motor vehicle” means every vehicle which is self-propelled.
      (c) “Residence” means any house, room, apartment, tenement or other building, vehicle, vehicle trailer, semitrailer, house trailer or boat designed or intended for occupancy as a residence.
Originally, part (a) covered only your home, so a burglar couldn't sue you for being shot while breaking into your home.

In 2015, this was amended to cover your vehicle and any justifiable use of deadly force in self-defense. 

​In order to maintain a lawsuit, the plaintiff would have to convince a judge that it really wasn't a case of self-defense. While it is not likely unless the situation is sketchy or you have deep pockets, you still don't want to risk defending a suit like this on your own. But don't take chances, get self-defense legal protection.
