![]() AB 291 has been amended to include “red flag” gun confiscation provisions and vague “safe storage” requirements. The bill has passed from the Senate Judiciary Committee to the full senate floor for a vote. After that, the Assembly votes to accept the amendment and if the Assembly approves it, the bill will then go to the governor for signature or veto. Red flag” gun confiscation have been billed as “extreme risk protection orders,” but are solely about keeping people from owning or possessing guns, allowing judges to order gun confiscation without due process with just a single accusation. Even buying a gun in the last six months could be used against you to justify “high risk behavior.” The “red flag” language in the bill is poorly written and vague. Furthermore, the “red flag” bill, SB 120, did not even get a hearing on its own, and was added in after the 11th hour. This bill has been pushed by out-of-state, gun control interests at the behest of Democrat politicians who have This bill is dangerous for Nevadans, it is dangerous for liberty, and will be expensive for the state to defend in court. Even if it is fairly applied in the near future, as California has shown, those who can apply for an order will expand to virtually anyone, greatly increasing the risk that this law will be abused to disarm any armed citizen. It contains an emotional and unnecessary ban against rate-increasing devices that could be construed to ban semi-automatic firearms. It would result in thousands of Nevadans becoming felons overnight and call for the confiscation and/or destruction of their property without compensation. The bill has also been amended to include “red flag” gun confiscation laws. Someone could have their firearms taken by police upon the unsubstantiated complaint of a relative. Vague firearm “safe storage” laws have been added into the law to make Nevada’s already strong child safety protections muddled instead of clearly-defined as they are now. More shenanigans from the Clown Legislature. Victor Joecks on Twitter said that the Democrats plan on adding "school safety elements" into AB 291. Red flag laws are a given at this point, but the "school safety elements" is scary. "Safety" to the hoplopaths means taking away rights.

The $10,000 donations were made by Everytown for Gun Safety to legislators: Sandra Jauregui, Steve Yeager, Ozzie Fumo, Julia Ratti, and Nicole Cannizzaro. Jauregui, Fumo, and Ratti all have active proposals being rolled into AB 291, Jauregui "Kitchen Sink" zombie gun control bill. Winning PAC received $5,000 of Everytown money to comingle with other donations I imagine, of which Marilyn Dondero Loop received $5,000 and Melanie Lyn Scheible received $10,000 (two $5k records are shown). Elsewhere, mass donations that were certainly comingled and re-distributed with other donation sources and given to the candidates were: $300,000 to Nevada State Democratic Party $250,000 Nevada Families First All Democrats dipped or benefited from party money. Overall, $17,081,595.07 was spent from Everytown in direct campaign donations, alone, from 2014. In 2016, over the battle over Question 1, Everytown spent almost $20 million. That's $37 million of what can essentially be called Michael Bloomberg's money trying to buy gun control in a far western state. AB 291 has been exempted from the deadline to pass out of committee. It should have died in committee today. As they have done this entire year, the Democrat-led legislators have changed the rules to do what they want. Unable to win honestly, the hoplopaths in Carson City have to cheat. See this news article from the Nevada Independent. The good news is that the proposed changes to remove state firearm regulation preemption at the county level is supposedly being rescinded. We expect SB 120’s “red flag” gun confiscation language to be added in along with the vague gun storage requirements from AB 153. Sandra Jauregui, sponsor of the awful bill, credited Everytown with telling her to let the preemption part go…because it is more important to drop the limit to carry while drinking by .02 BAC and to ban bump fire stocks that President Trump already banned. Jauregui has no decency waving the bloody shirt of the October 1 Mandalay Bay massacre to enact gun control which has little to do with the tragedy and would have done nothing to stop it. It’s unknown if this is an attempt to “sweeten” the bill to make it easier to pass or another one of this session’s games to cram as much gun control in Jauregui’s Kitchen Sink gun control bill. So email and vote online tonight and call the offices tomorrow morning. Make sure this thing doesn’t get a surprise hearing Friday afternoon. You don’t overturn 30 years of civil rights protections because Sisolak couldn’t virtue signal and ban bump fire stocks after the Mandalay Bay massacre. And to the point of “we need to make the Strip” safer, you don’t do that by banning lawfully carried firearms. You won’t make New Year’s Eve or any other time safer by disarming concealed carriers or any other gun control law. Local laws are so much easier to attack and protest. They also don’t seem to understand that the activist gun owners are heavily concentrated in the same county. We’ll have a field day with protests and activism. They will really recharge the gun rights movement and get more people more deeply involved. It’ll be fun until the lawsuits are successful and their crap ordinances are thrown out. New York State Rifle & Pistol Association Inc. v. City of New York promises to apply strict scrutiny to the Second Amendment which will doom pretty much every gun control law. The Heller decision’s clause about not casting doubt on long-standing prohibitions will likely go the way of the dodo because Scalia was compelled to put that in his opinion to ensure Justice Kennedy’s vote with the majority. Justice Kavanaugh will help fix Kennedy’s perfidy. In other words, the jurisprudence that is likely held by the conservative Supreme Court is that “shall not be infringed” means what it says. Like the freedom of speech, limits on the right to keep and bear arms must be limited to what is absolutely necessary for civilized order. Felons will still be prohibited from carrying, but “gun free zones,” permits, and “assault weapon bans,” will probably be smacked down in the district courts. For instance, SCOTUS vacates and remands anti-gun decisions like Peruta to be reviewed under the new standard, which means that California goes shall-issue at a minimum. If NYSRPA vs. NYC goes our way, when gun control laws get a successful decision in court, they die forever. So remember that Nevada hoplopaths; when we win, you lose. You’ll have to go full Maduro on us after that to get our guns. For one, it’s much easier for Clark County residents to appear in person at the commission meetings. County commissioners could be petitioned in person; they live near us and frequently appear at public events. Local ordinances are going to be attacked with much easier legal ease when they inevitably violate due process rights. Let’s not forget; many citizens have expressed a willingness to shut down the Strip with an open carry protest. Just imagine the consternation that a dozen rifle-toting citizens would cause walking down the Strip one afternoon in protest.
